The Department handles plan review, permit processing and inspections for new homes everywhere in the county except the City of Annapolis, which runs its own permit office. Since 1 December 2025, nearly all new permit applications must be filed online through the County's Land Use Navigator, which is also where inspections are booked and results checked.

Two districts cover most rural land. Rural Agricultural (RA) is meant to preserve farmland, with subdivision at roughly one home per 20 acres; Residential Low Density (RLD) allows one home per 5 acres. Both have a 40,000 square foot minimum lot and a 45-foot height limit. On top of zoning sits the Critical Area overlay for land within 1,000 feet of the Bay and its tidal tributaries.

The Department of Health takes perc applications for any lot that will rely on a septic system. Its site evaluation sets the size and type of system, and the lot must hold room for two future replacement systems. Poor results can mean a smaller house, and on some soils a lot can be developed only once public sewer arrives.

The Department of Health approves the well location as part of the building application. For a lot within 1,000 feet of a waterway or in the Critical Area, it asks owners to contact Planning and Zoning first, and it warns that a well inside the 100-foot buffer may need a County grading permit or a variance.

Critical Area classes and limits
The County's Critical Area Program, first approved in 1988, sorts shoreline land into Intense, Limited and Resource Conservation Areas. Resource Conservation Areas are limited to one dwelling per 20 acres, Limited Development and Resource Conservation sites must hold impervious surfaces to 15 to 31 percent, and a minimum 100-foot buffer applies (read 27 Sep 2026).

The Office of Planning and Zoning reports over 14,900 acres of working farms and forests preserved in the county. Its Rural Legacy Area, Anne Arundel South, covers 37,381 acres south of Central Avenue between the Patuxent and the Rhode River, and easements there extinguish development rights (read 27 Sep 2026).

South County acreage is the natural fit for a shop house, but check three things before you sign. First, the Critical Area designation on the County map, because a shoreline farm classed as a Resource Conservation Area carries its own density cap, clearing rules and a shoreline buffer where any disturbance generally needs an approved variance. Second, easements: a farm in the Rural Legacy Area or under a preservation easement may have given up its building rights. Third, the perc test, which in some areas can only be run in the wet season and decides how large a house the septic system will carry. Do I need a building permit for a barndominium in Anne Arundel County?
Yes. A barndominium used as a house needs a building permit like any other new home. Outside the City of Annapolis, the County's Department of Inspections and Permits issues it, and a lot on well and septic also needs Department of Health approval first. Can I build a barndominium on waterfront land in the Critical Area?
Often, but with limits. The County classifies Critical Area land into three types, and a Resource Conservation Area allows one home per 20 acres, with impervious surfaces capped and a buffer of at least 100 feet kept from the water. Vegetation removal there needs an approved plan. Check the County's Critical Area map for the parcel before you buy.
When does the Health Department run wet-season perc tests?
The County sets its wet-season test period each year from monitoring-well data. Anne Arundel County's 2024 wet-season notice says the highest water table usually comes in February, March and April, and that testing can end early if levels fall. Application deadlines change yearly, so ask the Department of Health about the current season.
Are there barndominiums for sale in the county?
Finished barndominiums for sale are rare here, and we do not list property. Most owners build on their own land: a kit put up by their crew, or a complete build from plans to move-in.
